Subject:                     Consideration of Request for Appointment of Members to the Building Board of Appeals in Compliance with 2022 California Building Code, Appendix B

 

Executive Summary: The recently adopted Appendix B of the 2022 California Building Code specifies that the Chief Appointing Authority of the jurisdiction, the Board of Supervisors in this instance, shall appoint a five (5) member Board of Appeals to hear appeals of the Building Official’s decisions. The Board of Appeals shall consist of individuals that are qualified by experience and training to pass judgement on matters pertaining to building construction and that are not employed by the jurisdiction. The Chief Appointing Authority is authorized to appoint two (2) alternate members.

 

Ordinance 1654 Section 19 was adopted on June 9, 1987, amending section 5-12 of Chapter 5   of the Lake County Code. This amended section specifies that the Board of Appeals shall be appointed by the Board of Supervisors and shall hold office at the Board of Supervisors ' pleasure. Currently, the Board of Appeals is comprised of the Board of Supervisors.

 

The City of Lakeport Building Division, Kelseyville Fire District and Lake County Fire Protection District have had internal discussions with the County and intend to use the same Board of Appeals to provide continuity throughout the County. When an appeal is requested at one of the above jurisdictions the process would include replacing the Board of Appeals member from that jurisdiction with William Collins, Chief Building Official, County of Lake.
