To:                                          The Honorable Lake County Board of Supervisors

From:

Subject:                     (Sitting as the Board of Directors of the Lake County Watershed Protection District) (a) Adopt Resolution authorizing the County of Lake Water Resources Director to apply for California Department of Water Resources (DWR) Flood Maintenance Assistance Program (FMAP) for much-needed levee maintenance areas within the Upper Lake levee system and Authorize the Chair to Sign

(b) Adopt Resolution for Operation, Maintenance, Repair, Rehabilitation, and Replacement (OMRR&R) and Authorize the Chair to Sign

(c) Approve the OMRR&R Agreement and Direct the Water Resources Director to Sign

Executive Summary:

Staff is requesting the Board of Supervisors, acting as the Directors of the Lake County Watershed Protection District (District), authorize the Water Resources Director to apply for the California Department of Water Resources (DWR) Flood Maintenance Assistance Program (FMAP) and Operation, Maintenance, Repair, Rehabilitation, and Replacement (OMRR&R) agreement.

The FMAP is a program that provides state funds for eligible maintenance activities to Local Maintaining Agencies (LMAs), including Maintenance Areas (MAs), for the purpose of obtaining acceptable maintenance if the State Plan of Flood Control facilities (Levees, channels, and structures).

The primary goal of the program is to reduce the chance of flooding and property damage during high water events; and, to improve the public safety, community preparedness, and emergency response.  Supporting goals are to improve operations and maintenance, promote ecosystem functions, improve institutional support, and promote multi-benefit projects.

This application, if approved from DWR, would allow the District to participate in FMAP program with DWR, to complete much-needed levee maintenance areas within the Upper Lake levee system.

The Operation, Maintenance, Repair, Rehabilitation, and Replacement (OMRRR) agreement and its resolution only needs to be signed/passed once when the County first joins the program. The resolution designating an agent to deal with the state, must be renewed annually. (Reference Attachment B in the packet).  There will be a third and final resolution accepting state funds which will need to approved to participate in FMAP.

Therefore, staff is requesting the Board to approve and sign the resolution(s) authorizing the Water Resources Director to submit an application to the FMAP and enter into agreement negotiations if granted. The final agreement, with project descriptions, will come before the Board for approval if awarded.
