Subject: 10:30 A.M. Public Hearing - Consideration of Resolution Vacating an Alley Easement for public use in the area of Middletown
Executive Summary:
A Resolution of Intent to vacate an unimproved alley easement was adopted by the Board on April 5, 2022 establishing today’s hearing. All required notices were posted.
Mr. Joseph Kitto, Pastor at First Baptist Church of Middletown, has petitioned the Board of Supervisors for the vacation of a portion of a 15-foot wide alley, located in the Middletown area of Lake County. The reason for the vacation is to allow a voluntary merger on the Church owned parcels. APNs 024-451-13 and 19.
The 15-foot alley had no offer of dedication shown on the map of Walter’s Addition to Middletown recorded on February 3, 1891 in Book 1 of Town Maps at page 52 (copy attached). However, the County Board of Supervisors vacated a portion of the alley in 1974 through the adoption of Resolution No. 74-156 (copy attached); thereby establishing the process staff is utilizing today to vacate the remainder. Following the findings of the aforementioned Resolution, staff recommends that the proposed action has no significant impact on the environment and is consistent with the Lake County General Plan. Furthermore, this vacation process would not land lock any properties and would terminate any public interest that may exist in the alley.
If the Board finds, from all evidence presented by interested persons, that the 15’ alley being vacated is unnecessary for present or prospective public use then the Board may adopt the Resolution of Vacation.
