Subject:                     Consideration of Appointing Qualified Candidates In Lieu of a General District Election for the Scotts Valley Water Conservation District Under Elections Code Section 10515

 

Executive Summary:

 

Elections Code Section 10515 requires the Registrar of Voters to submit a certificate of facts to the Board of Supervisors when the number of persons who have filed a Declaration of Candidacy for director does not exceed the number of offices of director to be filled at a general district election. To comply with Section 10515, I am submitting the required certificate of facts, attached, and requesting that the Board of Supervisors, acting as the supervising authority of the Scotts Valley Water Conservation District, appoint candidates who would be qualified on the date the election would have been held to fill those director positions that will be vacant due to no persons filing a declaration of candidacy for the November 4, 2025, election prior to December 1, 2025.

Recommended Action: 

 

(a) In lieu of holding a general district election on November 4, 2025 for the Scotts Valley Water Conservation District, the Board of Supervisors directs staff to find qualified candidates to be appointed to the positions that will be vacant due to no persons filing a declaration of candidacy for the November 4, 2025, election.

 

(b) The Board of Supervisors schedule a date to choose qualified candidates from action item (a) to fill the vacancies at least two weeks prior to the December 1, 2025, selection deadline.

 

(c) The Board of Supervisors directs staff to draft a resolution appointing the candidates chosen in action item (b) to fill the vacancies prior to the date selected in action item (d).

 

(d) The Board of Supervisors schedule a date to pass the resolution from action item (c) appointing the candidates to fill the vacancies at least one week prior to the December 1, 2025, selection deadline.
