SUBJECT:                     Consideration of a revised County Donations Policy, replacing section 10, subsection 40, and obsoleting section 10, subsection 33, and section 12, subsection 6, of the Lake County Policies and Procedures Manual.

EXECUTIVE SUMMARY:

 

As your Board is aware, the California Government Code, sections 25355 and 25356, empowers your Board to accept or reject any donation of cash, services and/or supplies made to or in favor of the County.  Your Board may also grant this authority to any elected or appointed County Department Head or the County Administrative Officer.

 

Your Board may also be aware that three County policies currently address donations.  The attached policy replaces the three previous policies with one comprehensive statement.

 

Existing policy is largely continued:

                     Soliciting donations without prior BOS approval is still prohibited

                     Donations of any kind for special County-related events (parties, employee picnics, department celebrations) must be accepted by the Board, regardless of value

                     Department Heads may accept donations up to $500

                     Donations up to $10,000 may be accepted by the CAO

                     Any donations with a value of more than $10,000 will be accepted by the Board

 

There are a few clarifications:

                     Donations of clothing and other household and personal items will not be accepted by the County

                     A quarterly report of accepted donations exceeding $10,000 must be filed with the CAO, for consideration of the Board (Gov. Code section 25355)

                     In every case, written acknowledgment of donations is the responsibility of the benefitting department, and a copy of the acknowledgment shall be provided to the CAO.

 

Some alternate pathways to accept donations are added:

                     Government-to-government donations of any value may be accepted by Department Heads upon verbal approval from the CAO.

                     Departments routinely receiving donations that preclude practical exercise of this policy shall seek a Board Resolution to readily accept donations in the County’s best interest.

                     The CAO, Sheriff or OES Director may accept unsolicited donations of any value during a declared Local Emergency, upon the CAO’s verbal approval.
