Pursuant to Lake County Code Chapter 13, Article VI, Section 13-42.1 - Upon completion of the abatement, the Board shall hear and consider the account and proposed assessment, together with objections and protests thereto.

 

On December 10, 2021, the property located at 11450 E State Hwy 20, Clearlake Oaks was found to be in violation of the Lake County Code (LCC):

 

                     LCC CH. 13, Article 1, Sec 13-3.1 (e) (7) - Existence of garbage, rubbish, or refuse.

                     LCC CH. 13, Article 1, Sec 13-3.1 (e) (8) - Any items causing an unsightly appearance which is visible from a public right of way or which provides harborage for rats and/or other vermin.

                     LCC CH. 13, Article 1, Sec 13-3.1 (e) (13) - Abandoned, dismantled, wreaked, or inoperable motor vehicles or parts thereof.

                     LCC CH. 21, Article 41, Sec 41.12 - Open and outdoor storage.

 

The property is an improved lot with a single family dwelling. There were several individuals staying on the property without owner permission.

 

County Records list the property owner as Trustee Cariveau, Thomas G (Cariveau). All notices (NONOTA dated December 10, 2021, NONOTA dated January 21, 2021, and 48-Hour Notice dated February 8, 2022) were posted on/at the property and mailed to Cariveau’s address listed on county records.

 

Summary Abatement Summary:

 

On February 07, 2022, Code Enforcement Manager Marcus Beltramo conducted a drive by inspection of the property. Conditions of the property had deteriorated and had become worse, now garbage, rubbish, and refuse were present and exposed to the elements necessitated a summary abatement. A summary abatement was requested from and granted by County Counsel and Supervisor Crandell.

On February 08, 2022, a 48-Hour Notice of Summary Abatement was posted on the property and emailed to the responsible parties. Only one contractor “Leonard’s Hauling” was available at the time of this summary abatement.

 

On February 10, 2022, the summary abatement was conducted by and which Leonard’s Hauling removed a total of 11,500 pounds of exposed wet garbage from the property and the immediate danger was abated from the property.

Abatement Summary:

 

During the summary abatement direct communication was established with Cariveau who had the legal authority to act on behalf of the property owner, who has health issues that limit his ability to manage his estate. Due to the deteriorating condition of the property from the issuance of the second NONOTA dated January 21, 2022, Code Enforcement moved forward with the abatement. Cariveau was contacted and agreed to move forward with the abatement.

 

On February 11, 2022, Code Enforcement received a signed Right of Entry Form from Cariveau. Allowing Code Enforcement and our contractors onto the property for the purpose of abating the noncompliance issues.

 

On February 17, 2022, the abatement was conducted by and which Leonard’s Hauling removed a total of 33,669 pounds of debris, tires, metal, house hold appliances, and other items not maintained in a manner compliant with the Lake County Code. Jones towing removed four (4) inoperable vehicles from the property.

On February 22, 2022, compliance with the Lake County Code was attained. The cost of the abatement was $10,468.70.

Recommended Action: 

Staff recommends the Board of Supervisors confirm the assessment of $13,974.30, and direct staff to Record a Notice of Special Assessment Lien against the property. The cost of summary abatement services was $2,074.54 (Leonard’s Hauling) + $601.46 (administrative fees) totaling to be $2,676.00. The cost of abatement services was $9,218.70 (Leonard’s Hauling) + $1,250 (Jones Towing) + $829.60 (administrative fees) totaling $11,360.52. The total cost of abatements on the property was $2,676.00 + $11,360.52 totaling $13,974.30.
