Subject:                     Consideration of Task Force/Ad Hoc Committee to Add Article 73 to Chapter 21 of Lake County Zoning Ordinance to Address Commercial Cannabis Permitting Activities and Enforcement.

 

Executive Summary:

On May 24, 2022, CDD presented to the Board of Supervisors a proposed Revised Cannabis

Ordinance to address Commercial Cannabis Permitting Activities and Enforcement. During the presentation, staff recommended that the Board provide a pathway for CDD to work with an appointed Commercial Cannabis Task Force committee to further address cannabis permitting activities.

 

As an important next step, I am recommending to the Board that a Task Force / Ad Hoc Committee be considered and approved to advance the orderly development of Draft #1 Revised Cannabis Ordinance. It is the goal of this appointed Commercial Cannabis Task Force to assist CDD in bridging the gap between stakeholders by developing meaningful actions and recommending solid regulatory standards that will address concerns surrounding: 1) The community; 2) Land Use & Zoning; and 3) The Environment.

 

CDD is recommending a seven member Task Force / Ad Hoc Committee to comprise of one representative from each of following organizations or groups: 1) Tribal Government, 2) Lake County Cannabis Alliance, 3) County Counsel, 4) Community Member, 5) Planning Commission, 6) Department of Cannabis Control, 7) University/Educational System, 8) Law or Code Enforcement, and 9) a Board of Supervisor. Attached is an application for consideration, attendance sheets and comments received from the Cannabis Workshops, and CDD's recommended topics and logistics to support Task Force. Refer to attachments.

 

CDD’s Recommendations to guide the Task Force:

I.                     Number of Task Force Members:  9

II.                     Goals: To review, discuss, consider and develop guidelines for regulatory solutions surrounding Commercial Cannabis concerns in the following areas:

1.                     Land Use and Zoning.

a.                     Hoop Houses.

b.                     ADA Standards and Requirements.

c.                     Setbacks for non-cultivation areas; and Buffers for water ways.

d.                     Exclusion Zones.

e.                     Fencing and vegetative screening.

f.                     Colocation of permits and clustering.

2.                     The Environment.

a.                     Hydrology/water usage.

b.                     Energy/Generators.

c.                     Fire/disaster planning.

d.                     Environmental Impact Reports.

e.                     Agricultural Standards.

3.                     The Community.

a.                     Transportation standards/4290 and 4291.

b.                     Mitigation of Odor, Noise and Dust.

c.                     Criminal Background Checks.

d.                     Tribal Consultations/Involvement.

e.                     Retail Standards - Non-cultivation projects.

i.                     Manufacturing, processing, and distribution including non-store front retail (dispensaries)

f.                     Tourism/Temporary Events.

III.                     Recommended Meeting Times and Locations.

The Task Force should meet every other week on Wednesday’s between 4:30 pm and 6:30 p.m. on June 29, July 20, August 3, August 17, August 31, September 14, September 28, October 12, and October 26.  Presentations to the Board on November 8, and November 15.
