Subject:                     10:00 A.M. - HEARING - Consideration of Request for Hearing regarding Code Enforcement Activity at 7180 Dodge Road, Nice (APN 032-091-18): Property Owner: Diana Anglero

 

Executive Summary:

The Lake County Code Enforcement Division received a request for a hearing before the Board of Supervisors regarding a Notice of Nuisance and Order to Abate issued against the property for violations of the Lake County Code.  In accordance with Lake County Code Chapter 13, Article I, Section 13-7 - A hearing before the Board of Supervisors regarding a Notice of Nuisance and Order to Abate may be requested.  When a hearing is requested the Board shall proceed to hear the testimony of the Enforcement Official, his/her assistants or deputies, the testimony of the owner or his/her representatives, and the testimony of other competent persons concerning the conditions constituting such nuisance, the estimated cost of abatement, and other matters which the Board may deem pertinent. Upon the conclusion of the hearing, the Board of Supervisors may terminate the abatement proceedings, or it may uphold the Notice of Nuisance and Order to Abate, prescribing the requirements of such abatement and prescribing the time for the completion of such abatement.

Investigation Background and Fact(s):

On April 22, 2025, a request for a hearing before the Board of Supervisors (appeal) was received from Diana Anglero (Anglero). The form asks for a reason why the property should not be considered a public nuisance.  Anglero provided the following reason: (Attachment B)

                     

“Pre-existing living, was superficial sheds, chicken coops; cleaned property.”

 

On November 30, 2024, Code Enforcement received a complaint alleging: “Abandoned Vehicle, Fence Setback violations, unsightly appearance and possible unpermitted construction.”

 

On March 3, 2025, Code Enforcement conducted a site inspection and verified violation(s) of the Lake County Code existed on the property.  Potential violations observed (1) unpermitted construction (entire structure), (2) unsafe structure, (3) no septic / unpermitted septic. Photos were taken via a County issued cell phone to document any violations (Attachment C). 

 

On April 7, 2025, Code Enforcement issued a “Notice of Nuisance and Order to Abate” (NONOTA) against the property.  The NONOTA provided a thirty (30) day period to correct the violations and provide for a twenty-one (21) day appeal period.  The NONOTA cited the following violation(s) of the Lake County Code: (Attachment D)

 

                     LCC Chapter 13, Article, I, Section 13-3.1 (e) (5) - Any use of land, buildings, or premises established, operated, or maintained contrary to the provisions of Chapter 5 (Building Regulations) and Chapter 9 (health and sanitation).

o                     2022 California Building Code - Section 105.1 - construction without first obtaining building permits.

o                     2022 California Building Code - Section 116.1 - Unsafe Structures

 

                     LCC Chapter 9, Article 3, Section 9-19.1 - It shall be unlawful for any person to construct, add to, modify or alter any privy, cesspool, septic tank, subsurface disposal system, excavation, effluent sewer pipes, conduits, or other means for the disposal, treatment or discharge of sewage without first securing a sanitation permit therefor from the County Health Officer.

 

Addition Note of interest:

 

The Community Development Department via its Building Safety and Code Enforcement Divisions have been in communication with the Anglero providing her education for obtaining the proper permits. Anglero has made statements or has been unable to provide information that she has the financial resources to demolish the structure or to pay for the required work to bring the structure into compliance

Recommended Action:  Staff recommends the Board of Supervisors uphold the Notice of Nuisance and Order to Abate and instruct staff to move forward with its abatement processes to remove the structure by demolition.
