Subject:                     Consideration of Resolution Approving Agreements for the Purchase of Right-of-Way for the Bridge Replacement Project on First Street over Clover Creek and Authorizing the director of Public Works to execute the Purchase Agreements on Behalf of the County of Lake

 

Executive Summary:

 

On January 13, 2015, The Department of Public Works entered into an Agreement with Bender Rosenthal Inc., to provide Right of Way services for Four (4) Bridge Replacement Projects and Two (2) Bridge Rehabilitation Projects in Lake County, CA.

 

The bridge on First Street over Clover Creek is slated for construction in 2024.In order to meet the schedule, the acquisition of portions of effected properties through fee title must occur.

 

By approving the purchase of fee title acquisition at the appraised fair market value for a portion of the listed parcel (attached to the Resolution as Exhibit A) and authorizing the County Administrative Officer or the Public Works Director to execute necessary documents, the process will be expedited and enable the County to secure the necessary right of way in time to proceed with utility undergrounding.  It should be noted that the project has been previously evaluated for environmental impacts, and it received an approved mitigated negative declaration on January 28, 2021.  Furthermore, the purchasing of property for the project is categorically exempt under California Environmental Quality Act (CEQA) Guidelines Section 15061 (b) (3) because it can be seen with certainty that these actions will have no significant effect on the environment.

 

This project is 100% funded for construction with state and federal funds. The Federal Highway Administration (FHWA) and Caltrans offer Federal Highway Bridge Program (HBP) funds and California Toll Credits to eligible projects. The FHWA, in an agreement with Caltrans, provides for the use of toll credits in lieu of local matching funds.

 

The proposed resolution attached to this memorandum, if adopted by your Board, will accomplish the above recommendation.

Recommended Action: 

 

Staff recommends that the Board of Supervisors approve the purchase of fee title acquisition for a portion of certain parcel (APN 027-221-110) attached to the Resolution and marked exhibit A, Authorize the Chair to sign the Resolution to purchase, and authorize the County Administrative Officer, the Public Works Director or his designee to execute the necessary documents.
