Executive Summary:

 

The overall Valley Oaks Project includes a phased subdivision of approximately 160 acres into a variety of residential, commercial, and other parcels, and has an extensive history of subsequent entitlements and actions taken by the Planning Commission and Board of Supervisors, spanning from 2005 through 2020. For brevity, a summary of actions specifically related to the approved tentative subdivision map (SD 06-01) and proposed Final Map (SD 24-06) is provided below.

The Valley Oaks Tentative Subdivision Map (SD 06-01) for the first phase of development, known as Village II, Phase 1, includes a 3.15-acre parcel (Lot 1 Grocery Outlet Parcel), another .55- acres parcel (Parcel H) and 0.54-acre parcel (Parcel G), that was approved by the Board of Supervisors on January 25, 2018 (Attachment 1). The Board of Supervisors approved an extension of the Tentative Map on May 26, 2020; October 22, 2022; and August 13, 2024, to allow the applicant additional time to complete the conditions of approval and file the final map. An application for the Final Map was submitted in July 2024 (Attachment 2). This first phase of the project will provide an opportunity for commercial development within the Middletown Planning Area; however, a specific development proposal is not included as a part of the Final Map. The Planning Commission will consider certifying the Final Map; and transmitting the Final Map to the County Surveyor for approval by the Board of Supervisors.

 

Recommended Action: 

 

Staff recommends that the Planning Commission find the Valley Oaks Final Map (SD 24- 06) substantially conforms to the approved tentative map and the conditions imposed thereon; certify the Final Map; and transmit the Final Map to the County Surveyor for approval by the Board of Supervisors, based on the following findings.

1.                     All required conditions of approval from the Tentative Map have been completed.

2.                     The Final Map is consistent with the Lake County General Plan, Middletown Area Plan and Zoning Ordinance.

 

3.                     The Final Map is consistent with the Lake County Subdivision Ordinance and the State Subdivision Map Act.

4.                     Per CEQA Guidelines Section 15162(a)(3), no additional environmental analysis is required because no development is proposed and there has been no substantial change in circumstances resulting in new significant environmental impacts since the EIR for the Valley Oaks Project (SCH No. 2007032030) was certified.
