Subject:                     Adopt Resolution of the County of Lake Board of Supervisors Approving, Authorizing and Directing Execution of a Joint Exercise of Powers Agreement relating to the California Cannabis Authority and authorize the Chair to sign

 

Executive Summary:

 

On June 6, 2023, your board directed administrative staff to prepare a budget request for annual membership in the California Cannabis Authority (“CCA” hereafter) to be funded by cannabis tax revenue.  Your board opted not to subscribe to CCA’s data analytics platform at that time.

 

The final budget approved Sept. 20, 2023, allocates $28,000 for the CCA annual membership.  Today’s agenda item presents a draft resolution and draft CCA joint-powers agreement for your board’s consideration and approval.  Billing for membership dues will commence upon receipt of these materials by CCA, as outlined in the agreement.  The draft resolution would appoint myself or other board delegate to represent Lake County on the CCA board.

 

County Counsel has reviewed the CCA joint-powers agreement and recommends several updates to California statutes cited within that agreement. Clean and redline versions are presented for discussion purposes. Greg Turner, CCA’s executive director and general counsel, has stated the JPA agreement does not require further review and approval by the CCA board even if amended when executed by a new member. Incorporating the code citation changes recommended by County Counsel promotes legal process efficiency for the County and CCA.
