Subject:                     Consideration of Rescission of Urgency Ordinance 3106

 

Executive Summary:

On July 27, 2021, your board enacted Ordinance 3106, titled as “an urgency ordinance requiring land use applicants to provide enhanced water analysis during a declared drought emergency.” The ordinance required hydrology reports to be prepared for all types of land-use applications without consideration of the project type or other site-specific conditions affecting water usage.

 

The county’s local drought emergency declaration was terminated by your board April 2, 2024. Nonetheless, the Community Development Department retains authority to require hydrological studies, among other studies, as deemed necessary when reviewing land-use applications.

 

As confirmed by county counsel, Ordinance 3106 contained a sunset clause that rescinded the ordinance in its entirety upon the termination of the local drought emergency declaration. This recission is not easily documented in MuniCode or Granicus without formal board action. The recommended action would create a formal record that Ordinance 3106 is no longer in effect.
