Subject: Sitting as the Board of Directors of the Lake County Watershed Protection District (a) Waive the formal bidding process, pursuant to Lake County Code Section 2-38 (2) & (3). (b) Approve the Agreement between the County of Lake and EOA, Inc. Environmental Consulting firm to provide assistance to meet National Pollutant Discharge Elimination System (NPDES) Storm Water Permit and Low Impact Development (LID) compliance and to authorize the Chair of the Board of Directors to sign the Agreement. (c) Approve the Reimbursement Agreements between the District, the City of Lakeport and the City of Clearlake to provide reimbursement for EOA, Inc. to complete LID and Storm Water Program services and to authorize the Chair of the board of Directors to sign the Agreements.
Executive Summary:
Attached for your approval, is the Agreement between the Lake County Watershed Protection District (DISTRICT) and EOA, Inc. The Agreement will provide Storm Water Permit and Low Impact Development (LID) Plan development, training, and adoption assistance and services. Approval of this Agreement will allow the County of Lake, and the two storm water co-permittees, the Cites of Lakeport and Clearlake, to satisfy current and outstanding storm water compliance deadlines, complying with requirements set forth through the state-mandated National Pollutant Discharge Elimination System (NPDES) permit. As well as simultaneously improving procedures for storm water smart building and development.
This item is not anticipated to be controversial and therefore is being placed as a consent item. This Agreement has been recommended by the seven-member Lake County Clean Water Management Council as a high priority plan that will help the County and Cities address high priority water quality issues on a landscape scale.
EOA,Inc. wrote the original 2003 Lake County Stormwater Management Plan and has most recently assisted the County and two cities to meet State-Mandated Total Maximum Daily Load (TMDL)compliance as well as additional storm water permit requirements. EOA, Inc. has an intimate knowledge of the joint program between the County and two Cities, has an excellent working relationship with district staff, and has the required expertise to assist the County in satisfying outstanding LID requirements. Additionally, due to the nature of the Co-Permittee Joint Agreement, it would not be in the best interest of the District, the County, or either city to embark into a cumbersome and lengthy RFP bid process that would not provide an economic benefit.
We also request the Board of Directors of the LCWPD approve and authorize the Chair to sign the two attached Reimbursement Agreements between the District and (a) the City of Lakeport and separately, (b) the City of Clearlake. These Reimbursement Agreements allow Lake County Storm Water Co-Permittees to cost-share an agreement between the District and storm water consultants EOA, Inc. to provide the LID and storm water services that are needed to meet permit compliance and protect water quality in Lake County.

1) Contract agreement between EOA, Inc. and County of Lake to complete LID storm water services, including Exhibit A, B, & C;
2) Both the reimbursement agreements, Between the District and City of Lakeport in the total amount not to exceed $18,358.28 for LID storm water compliance services (#2023001),
3) Between the District and City of Clearlake in the total amount not to exceed $32,697.00 for LID storm water compliance services (#2023002).
The expected completion date of all agreements is December 31, 2025.

Recommended Action:
