Subject:                     Second Reading - Consideration of Ordinance Amending Article I of Chapter 27 of the Lake County Code - Fire Mitigation Fees

 

Executive Summary:

 

At the May 21, 2024 Board meeting, the Ordinance was

 

The Mitigation Fee Act (California Government Code sections 66000, et seq.) provides authority for local governments to impose fees to offset the impacts of development on public facilities or services. The statute regulates how public agencies may collect, maintain, and spend development impact fees, including reporting requirements.

 

California fire departments can use fire mitigation fees, also known as development impact fees, as an effective tool to raise funds for expanding their fire protection and emergency medical response systems. These fees can fund construction and expansion of fire stations, training centers, administrative buildings, and other public services.

 

The purpose of Article 1 is to implement the Lake County General Plan policy providing for the adoption of fire mitigation fees and the collection of fees at the time of the issuance of building permits, said fees to be allocated to the affected Fire Agency for the acquisition of capital facilities in order to ensure the provision of the capital facilities necessary to maintain current levels of fire protection services necessitated by new development.
