Subject:                     Adopt Resolution Authorizing Standard Agreement No. 25-50257 Between the County of Lake and the California Department of Health Care Services and Authorize the Behavioral Health Director to Sign the Agreement

 

Executive Summary:

 

The County of Lake Behavioral Health Department has negotiated Standard Agreement No. 25-50257 with the California Department of Health Care Services (DHCS) for the continued administration, oversight, and funding of behavioral health programs and services within Lake County. Approval of this agreement is required to maintain the County’s participation in state and federally funded behavioral health programs and to ensure continued access to associated funding streams.

 

The agreement establishes the County’s responsibilities for program administration, service delivery, fiscal management, data reporting, and compliance with applicable federal and state laws, regulations, and DHCS requirements. It governs the implementation and oversight of behavioral health services funded through multiple sources, including Medi-Cal and other state and federal behavioral health funding mechanisms.

 

Standard Agreement No. 25-50257 incorporates multiple exhibits and attachments that collectively define the County’s obligations under the agreement, including the Scope of Work and program requirements, additional terms and conditions, and waiver provisions, if applicable; budget detail and payment provisions outlining reimbursement methodologies and fiscal requirements; general terms and conditions applicable to State contracts; special terms and conditions specific to behavioral health program compliance; additional provisions addressing program-specific requirements; and a Business Associate Addendum to ensure compliance with applicable privacy and health information laws.

 

The agreement also requires compliance with State-mandated Contractor Certification Clauses, which include provisions related to nondiscrimination, maintenance of a drug-free workplace, labor and employment compliance, conflict of interest restrictions, and other statutory requirements necessary to contract with the State of California.

 

Approval of this agreement authorizes the Behavioral Health Director to execute the agreement and any associated non-substantive amendments or administrative documents required by DHCS, ensuring timely implementation and ongoing compliance.

 

There is no impact to the County General Fund associated with this action. The agreement enables the County to continue receiving and administering state and federal funding for behavioral health programs and services without interruption. Failure to approve this agreement would jeopardize the County’s ability to administer behavioral health programs and could result in disruption of services and loss of associated funding.
