Subject:                     Approve Amendment No. 6 to the Tower and Ground Space License Agreement with AT&T and U.S. Cellular, which includes the County as signatory and ratifies the terms of the Fifth Amendment for equipment modifications made by U.S. Cellular and authorize the Chair to sign

 

Executive Summary:

Your Board will recall that there are two communication towers on Buckingham Peak of Mount Konocti.  One tower is owned by the County, while the other tower is owned by AT&T on ground space owned by the County. The license agreement between the County and AT&T stipulates that the County shall receive 50% of the rent paid to AT&T by any tower tenants of AT&T, and that the County shall also be signatory to any lease agreements between AT&T and their tenants.

 

One such tenant on AT&T’s tower is California Rural Service Area #1, Inc. d/b/a U.S. Cellular. On June 18, 2024, AT&T and U.S. Cellular entered into a Fifth Amendment to the Tower and Ground Space License Agreement, attached hereto as “Attachment A”. That amendment erroneously omitted the County as a signatory.

 

Attached for your Board’s consideration is a Sixth Amendment to the Tower and Ground Space License Agreement between the County, AT&T, and U.S. Cellular, which includes the County as signatory and ratifies the terms of the Fifth Amendment for equipment modifications made by U.S. Cellular.
