Subject:                     Approve Ratification of the Board of Supervisors’ Approval of Findings of Fact and Decision and Denial of the Appeal of Amy Hewitt-Novoa and Juan Novoa (AB 24-04)

 

Executive Summary:

On January 14, 2024, your Board approved the Findings of Fact and Decision and Denied the Appeal of Amy Hewitt-Novoa and Juan Novoa. This action was approved by a 4-0 vote of your Board, with Chair Crandell recusing himself and Vice-Chair Rasmussen serving as Chair.

 

Section 2, Rule 2 of the Board of Supervisors Rules of Procedure, General Protocol, and Committees Policy reads, in part, “[t]he Board observes a tradition of rotation for the election of Chair and Vice-Chair, but a member shall not be elected to serve as Chair unless he or she has been a member of the Board for the preceding calendar year.”

 

In order to avoid any potential ambiguity in the application of the aforementioned rule, staff recommends that your Board ratify the Findings of Fact and Decision and deny the appeal of Amy Hewitt-Novoa and Juan Novoa.

Recommended Action: 

 

1.                     Ratify the Board of Supervisors’ January 14, 2025 approval of the Findings of Fact and Decision on the Appeal of Amy Hewitt-Novoa and Juan Novoa, and authorize the Chair to Sign; and

 

2.                     Ratify the Board of Supervisors’ January 14, 2025 denial of the Appeal of Amy Hewitt-Novoa and Juan Novoa.
