Subject:   (Sitting as Lake County Sanitation District, Board of Directors) Adopt Resolution approving an exception to Lake County Sewer Code Sec. 205, allowing APN 012-026-140, located at 9586 S State Highway 29 in Lower Lake, to remain on a private septic system.

 

 

Executive Summary:

 

The subject property is currently within the Lake County Sanitation Service area, however, it is served by a private septic system which is in need of major repairs.

 

Per Sec. 205 of the Lake County Code (Sewer Use Ordinance); “The owner of any building situated or constructed within the District and abutting on any street in which there is now located or may in the future be located a public sewer of the District; is hereby required at his or her expense to connect said building directly with the proper public sewer in accordance with the provisions of this Ordinance, within ninety (90) days after the date of official notice to do so, provided that said public sewer is within two hundred (200) feet of the property line.”

 

The owner of the property located at 9586 S State Highway has obtained four (4) quotes, which have been attached for your review, ranging in cost from $96,355 to $160,000 (all with many exclusions) creating a significant and unreasonable hardship to connect to the public sewer.

 

Per Sec. 204 of the Lake County Code (Sewer Use Ordinance); “The Board may, on its own motion, find that by reason of special circumstances any provision of this regulation and Ordinance should be suspended or modified as applied to a particular premise and may, by resolution, order such suspension or modification for such premises during the period of such special circumstances, or any part thereof.

 

Due to the hardship to connect the property to public sewer, the owner of the property would like the Board to approve an exception to Lake County Code Sec. 205, and waive the requirement to connect to public sewer and to go forward with repairing the existing septic system.
