Subject: (Sitting as the Board of Directors of the Lake County Watershed Protection District) a) Approve an Amendment to the Professional Services Agreement between the Lake County Watershed Protection District and EOA, Inc. to extend the contract term for completion of the National Pollutant Discharge Elimination System (NPDES) Stormwater Permit and Low Impact Development (LID) Compliance Manual Update project; b) Approve corresponding amendments to the Cooperative Agreements with the City of Clearlake and the City of Lakeport to extend the project schedule for the Low Impact Development (LID) Stormwater services; and c) Authorize the Water Resources Director to execute the amendments and any related documents necessary to complete the project
Executive Summary:
On April 25, 2023 (File #: 23-394) the Board approved a Professional Services Agreement with EOA, Inc. (Attachment A) to provide consulting services for the ‘National Pollutant Discharge Elimination System (NPDES) Stormwater Permit and Low Impact Development (LID) Compliance Project’. Cooperative Agreements were also executed with the City of Clearlake (Attachment B) and the City of Lakeport (Attachment C) to reimburse the Lake County Watershed Protection District for each city's proportionate share of the project costs.
Project implementation was intentionally deferred while awaiting the development and release of the updated State Water Resources Control Board Phase II Municipal Separate Storm Sewer System (MS4) Permit requirements. Because the revised permit establishes new regulatory standards that directly affect the project's scope and implementation, delaying the work ensured that the updated Compliance Manual would be developed in accordance with the latest regulatory requirements, avoiding unnecessary revisions, duplicate work, and additional costs.
The State Water Resources Control Board has now released the draft Phase II MS4 Permit for public review, with final adoption anticipated in the near future. As the regulatory framework is now sufficiently defined, staff and the consultant are prepared to resume work on the project. Extending the term of the Professional Services Agreement and the corresponding Cooperative Agreements will provide adequate time to complete the remaining work and ensure consistency among all participating agencies.
There is no additional fiscal impact associated with this amendment. The amendment extends the contract term only and does not increase the total contract amount or the financial obligations of the participating agencies.
