a) Adopt Resolution Approving and Accepting Road Right of Way Relinquished by the of State of California (Streets and Highways Code Section No.73);

b) Adopt Resolution Protesting Road Right of Way Relinquished by the State of California (Streets and Highways Code Section No.73); and

c) Authorize the Public Works Director to sign the Controlled Access Agreement "Intention of Relinquishment"                     

 

Executive Summary:

 

On August 22, 2017, the County of Lake (County) and the State of California (State) entered a “controlled access highway agreement” regarding the realignment of State Highway 29 in the Kelseyville area. 

 

On October 21, 2025, the State provided a letter of intent to relinquish to the County right-of-way adjoining State Highway 29, as shown in the included maps as Segments 1 through 5.

 

County staff reviewed the proposed relinquishments and find Segments 1 through 3 to be acceptable for relinquishment, and Segments 4 and 5 to be unacceptable for relinquishment as they are inaccessible for maintenance purposes and unnecessary as County right-of-way. Staff prepared the attached two resolutions - one to accept Segments 1 through 3 of the proposed relinquishments, and one to protest the relinquishment of Segments 4 and 5 and accept the segments as roadway easements not to be maintained by the County.
