Subject: 10:00 A.M. - Public Hearing - Consideration of Agreement for the Purchase of Real Property Adjacent to the Eastlake Landfill in Clearlake; and B) Adopt Resolution Accepting and Recordation of Grant Deed.

Executive Summary:

On May 18, 2021, your Board granted conceptual approval for the purchase of 11.65-acre property adjacent to the Eastlake Landfill in Clearlake to support long term landfill expansion and operational needs. The Board appointed negotiating team has completed the required steps in the acquisition process, including securing an appraisal of the property, obtaining environmental input from Environmental Health, coordinating review of the Preliminary Title Report, and negotiating the purchase terms with the property owner, Pestoni Group Enterprises, for a price of $58,250.00.

The proposed acquisition includes portions of APN 010-053-11 and APN 010-053-14 immediately adjoining the Eastlake Landfill site. Public Services staff have worked closely with County Counsel, Environmental Health, and the Community Development Department to review environmental considerations, title matters, and conformity with the County policy.

Approval of the Purchase Agreement and Resolution will allow the County to move forward with securing the land necessary for future landfill capacity. Upon approval by your Board, Public Services will work with the title company to complete escrow, finalize documents for recordation, coordinate the required Certificate of Acknowledgment, and request issuance of payment through the Auditor-Controller's Office. Risk Management will also be notified to add the property to the County's insurance policies following close of escrow.
