Subject: Approve Amendment Two to the At-Cost Project Reimbursement and Indemnity Agreement Between County of Lake Community Development Department and Lotusland Investment Holdings, Inc. and Authorize the Chair to Sign


Executive Summary: The original agreement between the County of Lake and Lotusland Investment Holdings, Inc. was signed by the Board of Supervisors on April 25, 2017, for a special study area plan for the project known as Guenoc Valley. The County of Lake Community Development Department and Lotusland Investment Holding, Inc. entered into Amendment One on April 20th, 2024, amending Section 3 “PAYMENT OF DEPOSIT TO THE COUNTY” and Section 6 “AUTHORITY AND OBLIGATIONS OF THE COUNTY”. The County of Lake Community Development Department and Lotus Investment Holdings, Inc. now wish to enter into Amendment Two to amend Section 3 “PAYMENT OF DEPOSIT TO THE COUNTY” and Section 5 “AUTHORITY AND OBLIGATIONS OF THE COUNTY” and Section 6 “NO JOINT VENTURE OR PARTNERSHIP”

The County of Lake Community Development Department now processes and invoices all planning and building permitting through its online services platform OpenGov. Accordingly, the developer shall be responsible for all applicable permit fees, plan review fess, and cost associated with staff time dedicated to Project Services and Project Management Services through the OpenGov portal. Time spent by County of Lake staff will be billed at the time service is provided.
