Subject: Sitting as LCAQMD Board of Directors - Consideration to: (a) Waive the competitive bidding procedures pursuant to Lake County Code Section 2-39.2 and Section 1.C.2 of the County's Consultant Selection Policy; and (b) Approve Entering into an Agreement with ATA Law Group not to exceed $50,000 and authorize the APCO to sign the agreement
Executive Summary:
The District, in coordination with County Counsel, is requesting authorization to enter into and agreement for outside counsel to assist with enforcement cases. Due to the need for specialized services for enforcement of local, State, and Federal Clean Air Act requirements, District staff and County Counsel agreed that outside counsel is the best option for the District.
District staff has worked with County Counsel to identify counsel capable of performing the specialized services needed for enforcement of air quality regulations. Aqua Terra Aeris (ATA) Law Group specializes in air quality regulations and is contracted with multiple air districts statewide for enforcement assistance. ATA Law Group worked with County Counsel and the District to develop the attached Agreement for Services.
