SUBJECT: Approve the Site License Agreement with New Cingular Wireless PCS, LLC, and California Internet LP for Occupancy of Tower on Buckingham Peak, which will provide $300/month to the County and authorize the Chair to sign the Agreement
EXECUTIVE SUMMARY:
Attached for your review is a proposed Site License Agreement with New Cingular Wireless (commonly known as Crown Castle) and California Internet. The proposed agreement provides for California Internet to operate broadband services on a telecommunications tower owned by Crown Castle located on County property on Buckingham Peak of Mt Konocti.

The County presently holds a ground lease with Crown Castle, through which the County receives 50% of all revenue from tenants that Crown Castle allows on its tower. This agreement will provide $300/month to the County.

It is important to note that the County owns an adjacent telecommunications tower on Buckingham Peak that currently includes two broadband service provider tenants. As such, there is language in this proposed agreement that addresses the consequences should California Internet's broadband activities interfere with County tenant operations.
