SUBJECT: Adopt Resolution approving the intent to participate in the deferred maintenance program to receive state funds under section 6.10 of Senate Bill 826 (Stats. 2016, Ch. 23) and authorize chair to sign
EXECUTIVE SUMMARY:
The proposed resolution supersedes a resolution approved by the Directors on August 8, 2017; the current agreement will increase funding amount to $82,080 (formerly $40,000). The California Department of Water Resources (DWR) is offering Lake County Watershed Protection District $82,080 as a reimbursable grant for video inspection of through-levee culverts. The District currently has $100,000 in a line item for a Corps of Engineers study of the Middle Creek levees that will not be spent until the Middle Creek Restoration Project moves forward. Staff recommends using the Corps study funds to support the up-front costs of the video inspection with the knowledge that the funds will be reimbursed prior to the need for the Corps study.
County Counsel has cautioned that as currently written part D of the funding agreement, which may be signed in the next phase of the project, requires the County to acknowledge a greater degree of maintenance responsibility for any repaired or replaced levee penetrations. We will work with the Department of Water Resources to ensure that the extent of required maintenance does not exceed that to which we have already agreed.
