Subject: Sitting as the Board of Directors for the Lake County Watershed Protection District Review and Approve "Just Compensation" Estimates for the purchase of Properties within the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project and authorize the Chair of the Board of Directors to sign the Approval

Executive Summary:

Our consultant Monument Inc. (Consultant) has prepared an Approval of Just Compensation (Approvals) (Attachments A, B, C, and D) for the purchase of the following properties for the listed prices:

1. Assessor Parcel Numbers (APNs) 004-010-050 & 004-013-050 for the cost of $1,200,000;

2. APN 004-013-110 for the cost of $650,000;

3. APNs 004-010-18, 004-010-19, 004-010-20, 004-013-06 & 004-013-12 for the cost of $775,000; and

4. APNs 004-010-100 & 004-013-080 for the cost of $450,000.

The appraisal for each property (Attachments E, F, G, and H) was prepared by a third party hired by our consultant and has been reviewed and approved by the State of California, Department of Water Resources Real Estate Division. Each purchase will be funded through grant funds provided by the State of California, Department of Water Resources and the Flood Corridor Program, following the provisions required by the Uniform Relocation Assistance and Real Properties Acquisition Policies Act of 1970.

Each of these properties is located within the Middle Creek Project Area. Their purchase is forward progress toward the development of the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project.

FISCAL IMPACT (Narrative):

The purchase of these properties is being completed via reimbursement using grant monies provided by the State of California, Department of Water Resources, and the Flood Corridor Program, California Department of Water Resources (DWR) Agreement No. 4600012946.
