Subject: Approve Amendment No. 2 to the Agreement between County of Lake and the Smithwaters Group for Fiscal Years 2022-25 with no change to the contract maximum and authorize the Board Chair to Sign.

Executive Summary:

This amendment reflects a change to the number of hours provided each month, increasing the number of hours from 65 to 86 hours per month. This is necessary due to the changes resulting from AB 2275 (Wood). This measure clarifies that the 72 hours of detention under a Lanterman-Petris-Short Welfare and Institutions Code section 5150 involuntary hold begins at the time when the person is first detained. AB 2275 also specifies timelines for holding a certification review hearing when a person is certified for intensive treatment and requires that a person be advised of rights to a hearing when they are detained. The patient's rights organization has a role in these recertification hearings.
