Subject: Consideration of (a) waiving the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services; (b) approving payment of Pre-Sort Center Invoice #112685 for $5,905.41; (c) approving agreement with the Presort Center for printing and mailing services in an amount not to exceed $200,000.00.

Executive Summary:

There are statutory requirements associated publication for the Tax division of our office, including legally mandated publications in the newspaper. The County's ordinance does not specifically contemplate the practical constraints imposed by these requirements under narrow timeframes. For example, postage and newspaper publication costs are unique by their nature, typically representing the most significant cost of transactions, but they do not lend themselves to competitive bidding. Due to logistical constraints, envelopes and other specialized materials, as well as postage, need to run through the same vendor that does the printing.

Our office requests the Board of Supervisors find that the costs of publication, pursuant to Section 38.2(2), that competitive bidding for these expenditures would not be in the public's interest because the unique nature of the goods or services precludes competitive bidding. This finding is requested for up to $200,000 in expenditures annually. This finding and authorization is critical to ensure compliance with statutory requirements.
