Subject: Adopt Resolution Establishing the Survey Monument Preservation Fund and Imposing a User Fee of Five Dollars ($5.00) per Recorded Deed

Executive Summary:

Government Code Sections 27584 & 27585 (attached) authorizes the Board of Supervisors to establish a survey monument preservation fund for retracement or re-monumentation surveys of major historical land division lines upon which later surveys are based.

The typical project is intended to be situations when the costs of a survey are too high to be feasible for any individual homeowner, but the benefit to the community of a proper survey would be significant. See the attached list of examples for more details about past projects funded with Monument Preservation funds in other Counties, as well as possible future projects here in Lake County.

County approval must be obtained prior to the commencement of any survey for which these funds will be requested. A Record of Survey or Corner Record, whichever is applicable, must be filed for each project. Monuments to be set must be of a permanent and durable nature.

Staff has drafted the attached Resolution to clearly define the Survey Monument Preservation Fund. Staff proposes the effective date align with the new fiscal year, July 1, 2024.
