Subject: 10:00 A.M. - (Sitting as the Lake County Air Quality Management District Board of Directors) Workshop and Hearing for the Draft Replacement Fee Schedule, (Rules 660-662) and Updates to District Rules 208.2, 226.5, 433.5, 1002, and 1105, and Repeal of District Rules 631, 12.450, and 12.640.

Executive Summary:

The Lake County Air Quality Management District (District) is required to follow the legal process outlined in California Health and Safety Code in order to adopt new rules or fees, modify existing rules, and to repeal rules. This workshop and hearing is intended to start the process, in compliance with H&SC 42311.

The District is proposing to repeal the existing fee rules and replace them with a new fee rule and structure. The new structure is intended to provide clarity and better transparency to the District fees. The District has not increased fees since 1996, other than implementation of the burn permit fee in 2003 and CPI adjustments. The costs of operation and requirements placed on the District have increased significantly more than CPI since then.

Other rules proposed to be updated include the lifting of the burn ban, and necessary changes to the burn rules related to changes in Fire Agency participation in the burn program. The District is proposing to repeal several rules required to be repealed by EPA, as they are no longer enforceable and have been repealed by EPA during the past 2 years.

This workshop and hearing is an opportunity to receive public comment and Board direction on the proposed changes, prior to submitting them to the State of California and EPA for comment. After which the final proposed rules will be brought back to the Board of Directors for consideration.
