Subject: Approve Amendment No. 5 to the Courthouse Facility Space License Agreement with New Cingular Wireless PCS, LLC
Executive Summary:
New Cingular Wireless (a subsidiary of AT&T) leases space from the County on the courthouse roof to accommodate their cellular equipment. New Cingular had been considering installing their own generator to provide for their emergency power needs, but reconsidered upon learning of the County’s installation of its own emergency standby generator. After their evaluation of the County generator’s available capacity, New Cingular has concluded that it is sufficient to serve their emergency power needs.
Staff negotiated with New Cingular for a $250.00 per month payment for their ability to draw power from the emergency standby generator that serves the Courthouse “to the extent emergency power is available.” In other words, the proposed arrangement does not guarantee New Cingular uninterrupted access to emergency power and prioritizes the County’s need for emergency power.
Attached for your consideration is an amendment to the lease agreement with New Cingular Wireless which memorializes this generator sharing arrangement.
