SUBJECT: Adopt Resolution Approving Right of Way Certification for Oak Tree Mitigation Project at Cole Creek Bridge on Soda Bay Road, in Lake County, CA Federal Project Number: BRLS-5914(108); and authorize the Public Works Director to execute the Right of Way Certification.
EXECUTIVE SUMMARY: A total of fourteen (14) oak trees were removed as part of the bridge replacement project on Soda Bay Road over Cole Creek. CEQA Mitigation Measures and California Department of Fish & Wildlife's Lake or Streambed Alteration (LSA) Agreement require that removed oak trees be replaced at a ratio of 2:1 and 3:1, respectively. LSA Agreement further requires that replanting occur in the fall and exhibit a 75% survival rate after three (3) years and that annual monitoring reports be submitted for a period of five (5) years after replanting.
In order for federal funds to be approved, it is required that the County of Lake certify the right of way required for oak tree mitigation project under Federal Project Number BRLS-5914(108) and submit a Right of Way Certification to the California Department of Transportation.
Staff has prepared the attached Resolution and Right of Way Certification to certify that all mitigation activities will occur within County-owned right of way.
Staff recommends that the Board of Supervisors adopt the Resolution Approving Right of Way Certification for Oak Tree Mitigation Project at Cole Creek Bridge on Soda Bay Road, and authorize the Public Works Director to execute the Right of Way Certification.
