SUBJECT:                     Introduction of an Ordinance Amending Section 2-192.1, Article XXVI, Chapter 2 of the Lake County Code, Providing Authority to Execute Leases and Licenses

 

EXECUTIVE SUMMARY:

 

In June of 2011, your Board granted the County Administrative Officer authority to execute leases and licenses of County real property on a limited basis.  This authority expired December 31, 2015, although this just recently came to my attention.  Staff has reviewed all relevant ordinance sections, and recommends amending the language regarding expiration of this section, given this change has facilitated a more transparent process for those leasing or licensing County property, without any detriment to the County.

 

Section 25537 of the California Government Code empowers your Board to authorize a county officer or officers to execute leases and licenses on a limited basis for a period of no more than five years.

 

Section 2-192.1, Article XXVI, Chapter 2 of the Lake County Code presently reads:

 

“192.1 The County Administrative Officer, or his/her designee is authorized to execute leases and licenses let pursuant to Section 2-191 and upon approval of the Board of Supervisors under Section 2-190.  Such authority shall expire on December 31, 2015.”

 

At this time, staff recommends your consideration of this new language:

 

“192.1 The County Administrative Officer, or his/her designee is authorized to execute leases and licenses let pursuant to Section 2-191 and upon approval by the Board of Supervisors under Section 2-190.  Such authority shall expire on July 1, 2022.”

Recommended Action

RECOMMENDED ACTION:  Staff recommends your Board introduce the above amendment of Section 2-192.1, Article XXVI, Chapter 2 of the Lake County Code.  This can be done either by reading staff’s recommended paragraph or reading the title and voting (majority) to waive full reading.
