SUBJECT: SECOND READING - An Ordinance Establishing and Prescribing Sewer Service Charges for Anderson Springs

EXECUTIVE SUMMARY:
In September 2015, 198 of the 212 homes in the Anderson Springs Community burned in the Valley Fire. Most of these homes cannot be rebuilt under current building and set back codes without a sewer system. Various agencies and individuals have been working together to fund and construct a sewer system. Grant funding applications have been submitted and are in progress with State Water Resources Control Board (SWRCB), United States Department of Agriculture-Rural Utilities Service (USDA-RUS) and Community Development Block Grant (CDBG). The estimated cost of the sewer system is $10,580,763.
The construction costs will be provided with grant funds but sustainable rates and fees must be in place to operate and maintain the system when it is placed into operation.
In compliance with California Proposition 218, Article XIIID property owners that are included in the sewer system were mailed a letter explaining the basis on which the fees and charges were calculated, the public hearing and actions to be considered and the protest procedure. This letter was mailed on June 6, 2017 along with a draft of the proposed rate ordinance.
There are 316 parcels included in the proposed system. Per Proposition 218, a total of 159 written protests will defeat this rate proposal. (50% plus 1 vote).
