SUBJECT: FAA Entitlement Transfer Agreement
EXECUTIVE SUMMARY:
This item is being submitted as an “extra” agenda item. The justification for this request to consider an item not on the posted agenda is as follows:
- The need to take action came to the attention of this department subsequent to the posting of the current agenda.
The Public Works Department was contacted on Tuesday, July 25th and notified that there was a project currently underway that was in need of additional funding.
- There is a need to take immediate action before the next available agenda.
The FAA is approaching the end of their fiscal year and in order to complete expenditures of current construction projects they have a policy of having all grants awarded by July 31st. The agency that will receive the entitlement transfer cannot receive the grant from the FAA and award the bid until this agreement paperwork has been received.
Staff requests that the Board of Supervisors concur that justification exists to consider this for an extra agenda item.
Every year, general aviation airports throughout California receive funds from the FAA for use on capital improvement or maintenance projects. Lampson Airfield is no different, and the Department of Public Works, the managers of the airport, has been accruing these funds in order to complete a pavement rehabilitation project. The pavement rehabilitation project is scheduled for next construction season.
FAA regulations only allow the accrual of four (4) years of entitlements for a total of $600,000. Lake County has reached the maximum accrual and due to the incongruence between the local and federal fiscal year calendars, and the timing of our construction project, we face the expiration of an annual entitlement. FAA regulations also allow a transfer of funds between agencies, and we have been asked to consider such a transfer to allow a project to be completed at the City of Hanford’s Municipal Airport. This project has been put out to bid, and based on the results, their funding shortfall would be made up through the use of our entitlement. I am of the opinion that the goodwill created not only with the City of Hanford, but with the entire general aviation community, will benefit Lake County in some way on our future projects. It should be noted that the engineer’s estimate for the aforementioned pavement rehabilitation project is over $700,000, so we may find ourselves is a similar position with our own project next year.

Recommended Action
RECOMMENDED ACTION: Staff recommends that your Board approve the transfer of entitlement funds from Lampson Airfield to the City of Hanford, and authorize the Public Works Director and County Counsel to sign the FAA Entitlement Transfer Agreement.
