SUBJECT:                     Extra agenda items for November 14, 2017:

 

(a)                     Consideration of adoption of the state-mandated November 13, 2017 deadline for return of Right of Entry (ROE) forms from Sulphur Fire survivor/owners for participation in the County/CalOES/FEMA debris cleanup program

 

(b)                     Consideration of adoption of a Sulphur Fire debris cleanup deadline in early 2018 for all survivor/owners who do not return an ROE form, thus opting not to participate in the County/CalOES/FEMA debris cleanup program

 

EXECUTIVE SUMMARY:

 

Staff requests the Board consider these items as “extra” during your November 14, 2017, for the following reasons:

 

1.                     The need arose after the posting of the agenda

2.                     The need to take action is required before the next regular Board meeting on November 28, 2017

 

(a) As you recall, during your November 7, 2017, your Board considered adopting the state-mandated deadline of November 13, 2017 (or earlier) for participation in the County/CalOES/FEMA debris cleanup program for the Sulphur Fire.  However, instead of adopting a deadline, your Board directed staff to write a letter to CalOES requesting the state-mandated deadline be extended by two weeks to November 27, 2017.

 

CalOES responded to your request for a two week extension, explaining that the November 13, 2017 deadline is necessary because the debris presents risks to public health and to the environment.  Further, the state is requiring that the County provide a list of all properties opting into the program by November 21, 2017.  CalOES advises that the deadline is necessary to ascertain the scope of the remaining debris removal threat to health and safety and ensure all of it is removed by early 2018. 

 

(b) Finally, in a separate communication, CalOES advises that the County should also establish a cleanup deadline in early 2018 for Sulphur Fire survivor owners that do not sign an ROE by the November 13, 2017 deadline.  Per the guidance received from CalOES, failure to sign an ROE form by the November 13, 2017 deadline is considered an “opt out” of the County/CalOES/FEMA program and such survivor/owners are responsible to complete the cleanup process using their own contractor.  Napa County, for example, has adopted January 15, 2018 as the deadline by which survivor/owners who opt not to participate in the County/CalOES/FEMA debris cleanup program must complete their cleanup.
