SUBJECT: Approve Amendment Two to the Agreement between the County of Lake and Bender Rosenthal, Inc. to provide Right of Way Services for Four (4) Bridge Replacement Projects and Two (2) Bridge Rehabilitation Projects in Lake County, CA for an increase of $10,580 and an amount not to exceed $148,080; and authorize the Chair to sign.
EXECUTIVE SUMMARY: On January 13, 2015, the Department of Public Works entered into an Agreement with Bender Rosenthal, Inc. for Right of Way Services for Four (4) Bridge Replacement Projects and Two (2) Bridge Rehabilitation Projects in Lake County, CA. The six bridges are Anderson Creek Bridge on Foard Road (14C-0076), Manning Creek Bridge on Mathews Road (14C-0082), Manning Creek Bridge on Ackley Road (14C-0083), Highland Creek Bridge on Highland Springs Road (14C-0085), Robinson Creek Bridge on Mockingbird Lane (14C-0086), and Harbin Creek Bridge on Harbin Springs Road (14C-0111). Amendment One, executed on December 28, 2017, extended the term of the Agreement.
With the exception of Mockingbird Lane Bridge, right of way services have been completed for the other bridges on this Agreement. The acquisition process for Mockingbird Lane Bridge has required additional effort due to the increased number of affected parcels and the added complexity of negotiations for APNs 004-081-03 & 04. For these two parcels, Bender Rosenthal prepared an updated appraisal, held additional site meetings, prepared a Possession and Use Agreement, and conducted additional coordination with Caltrans and the County. Staff has received concurrence from Caltrans on the additional cost of Bender Rosenthal's services.
This amendment will provide for the additional effort required for Mockingbird Lane. As a result, the contract amount will be increased by $10,580.00 to a new total not-to-exceed amount of $148,080.00.
