SUBJECT: Adopt Resolution Authorizing Conducting Criminal Background Checks for Commercial Cannabis Licensing Purposes

EXECUTIVE SUMMARY:
With the likely forthcoming implementation of local commercial cannabis rules, regulations and ordinances, it is apparent that the Lake County Sheriff's Office will be responsible for conducting background checks on applicants for commercial cannabis licenses and/or permits.

A part of those checks include a review of summary criminal history information that is obtained from the California Department of Justice by electronically submitting fingerprints to that agency through a process commonly referred to as "Livescan". The Sheriff's Office currently has the authority and the ability to run Livescan checks on subjects for licensing, employment, certification, or other such activities, however we are only provided California summary criminal history information through our current process.

In order to review interstate records and records held by the Federal Bureau of Investigation, it is necessary to obtain the proper authorization from your Board by way of Resolution granting that authority. Upon receipt of an adopted Resolution, we may submit it with an application to the FBI for access to FBI summary criminal history information that will reveal convictions for crimes in jurisdictions outside California. The approval process takes several weeks from the time of the application. This ability to review multi-state summary criminal history information will allow the Sheriff's Office to properly vet applicants for permits and/or licenses for commercial cannabis activity to ensure that only qualified people are licensed.

The Sheriff's Office requests your Board's consideration and adoption of the attached Resolution which provides the necessary authorization from the governing body.
