SUBJECT: Approve grant of sewer easement across APN: 050-471-08 to the Lake County Sanitation District and authorize chair to sign.
EXECUTIVE SUMMARY:
At the request of the Lake County Sanitation District, today’s item is for the consideration of a sewer easement across County owned property in the community of Anderson Springs. The community of Anderson Springs was constructed in the 1870’s before the County secured right-of-ways for public road and utility purposes. Since that time, the County has claimed a prescriptive right-of-way for public road purposes due to the ongoing public use of roads in Anderson Springs for many decades. The prescriptive nature of the road easement prevents the Lake County Sanitation District from utilizing it for public sewer purposes without obtaining additional rights to the land for public sewer purposes. The purpose of this easement is to grant the Sanitation District the right to construct the sewer main within the prescriptive right-of-way of Anderson Springs Road and Foard Road. The Lake County Sanitation District is completing this process with all landowners in Anderson Springs in order to secure the right-of-way for the sewer project. A copy of the easement is attached.
