SUBJECT: Approve Right-of-Way and Temporary Construction Agreement with Digital Path Inc. on Buckingham Peak and authorize the Chair to sign.
EXECUTIVE SUMMARY:
Digital Path, Inc. is one of the two broadband tenants that occupies space on the County’s Buckingham Peak communications site. They are requesting permission to dig a trench and install a conduit that will accommodate an AT&T-owned fiber optic cable which will not only serve their needs but will also provide fiber optic access to all other County tenants that occupy communications vault. The attached Agreement provides Digital Path with permission to construct, install and maintain the conduit and fiber optic cable but stipulates that ownership of the conduit will reside with the County thus providing assurance that we can make it available to our other tenants.
