SUBJECT:                     PUBLIC HEARING:  Adopt Resolution Approving the Community Services Districts’ Election Date Change for Governing Body Members from Odd-Numbered Years to the Same Day as the Statewide General Election Held in Even-Numbered Years; and Impact Analysis/Cost Effectiveness Report

EXECUTIVE SUMMARY:

 

In response to the “California Voter Participation Rights Act, SB 415” signed into law by Governor Jerry Brown on September 1, 2015, which requires districts with regularly scheduled odd-year elections with at least 25% less than the average turnout of previous four statewide general elections to adopt a plan to change to the same day as the Statewide General Election held in even-numbered years; the Community Services Districts enumerated in Exhibit “A” attached to this Resolution have complied with the requirements of SB 415.

 

The Anderson Springs Community Services District and the Butler-Keys Community Services District (“Community Services Districts” enumerated in Exhibit “A” attached to this Resolution) Board of Directors’ adopted a resolution requesting the Lake County Board of Supervisors to consider changing each of the Community Services District’s Governing Body Member Elections from odd-numbered years to even-numbered years and your Board accepted each and every Community Services District’s Resolution at your regular meeting on April 10, 2018.

 

Elections Code §10404 requires your Board to approve the attached Resolution changing each of the Community Services Districts’ Governing Body Member Election Dates to even-numbered years commencing with the November 3, 2020 Statewide Presidential General Election since the Registrar of Voters has determined that the change of election date will not cause the ballot layout, computer capacity or computer equipment to be exceeded with the consolidation of the Community Services Districts’ Governing Body Member Elections.  Additionally, the Registrar of Voters estimates that by consolidating the Community Services Districts’ Governing Body Member Elections with the even-numbered year Statewide General Elections, each of the Community Services District’s share of costs would be substantially reduced from an odd-numbered year election; and, as an added benefit, each Community Services District’s Governing Body Member Election will most likely have a greater voter participation if changed to even-numbered year elections.

FISCAL IMPACT (Narrative):

Each of the Community Services Districts will be required to pay for any additional costs the Registrar of Voters office incurs as a result of a Community Services District’s consolidation with the Statewide General Election.  Community Services District candidate names are only printed on the ballot if there are more candidates than there are vacancies to be filled on the board of directors.  When the number of candidates to be elected does not exceed the number of vacancies to be filled, there is no election held for governing body members and the Board of Supervisors will appoint the nominees in lieu of holding an election on the day of the scheduled election.  Consequently, the fiscal impact is unknown at this time.

Recommended Action

RECOMMENDED ACTION:

It is recommended that your Board adopt the attached resolution titled “Resolution Approving the Election Date Change for Governing Body Members of Community Services Districts from Odd-Numbered Years to the Same Day as the Statewide General Election Held in Even-Numbered Years” at this meeting.  Following your Board’s adoption of this Resolution, the Registrar of Voters is required to notify all registered voters residing within the boundaries of each of the Community Services Districts enumerated in Exhibit “A” by mail affected by the change of election date at the expense of each of the Community Services Districts.
