SUBJECT: Consideration of Request for Board Validation of the Public Works Directors Emergency Action in the Robinson Creek Bridge Rehabilitation Project

EXECUTIVE SUMMARY:

In February, 2018, in my official capacity on behalf of the County of Lake and with the approval of your Board, I entered into a right-of-way contract (Contract) with Nancy Jane Williams (Property Owner), whose property was impacted by the County's Robinson Creek Bridge Rehabilitation Project. The Contract provided for a series of payments to be made by the County to the Property Owner, with the final payment, pursuant to the terms of the Contract, being due within 30 days of the County's completion of the Project.
The Contract required that the Property Owner be allowed to construct water lines across Robinson Creek. The State Department of Fish and Wildlife imposed a deadline of October 15th for all work to be completed within Robinson Creek, which also applied to the Property Owner. Although the project is substantially complete, the final completion requires coordinated efforts by the County and the Property Owner in order to comply with the deadline imposed by the State. It became a matter of urgency that the final check be issued to the Property Owner ahead of schedule in order for her to complete her portion of the work.
Due to the emergency nature of the above-described situation, and with the assistance of the County Counsel's Office, I executed the attached modification to the Contract which allowed the Auditor-Controller to issue an emergency payment to the Property Owner. Pursuant to the terms of this modification, I respectfully request your Board's validation of this action.
Staff recommends that your Board concur that there was sufficient justification for modifying the Contract, and validate the Public Works Directors actions in doing so.
