SUBJECT:                     Consideration of Agreement between the County of Lake and Peterson Brustad Inc. in the Amount of $483,804.00 for the Middle Creek Flood Control Feasibility Study for the Community of Upper Lake, and Authorize the Chair to Sign

 

EXECUTIVE SUMMARY:  The California Department of Water Resources (CDWR) developed the Small Communities Flood Risk Reduction Program (Program) to help fund feasibility studies and system upgrades to levee systems to reduce flood risks in non-urban areas. The Program assists local governments by providing technical and financial support to improve flood control facilities of the State Plan of Flood Control (SPFC) for small communities (<10,000 population). 

On December 18, 2015, your Board approved a request to the Program to fund a levee Feasibility Study that will identify upgrades and improvements to the Middle Creek Flood Control Project (Project) which provides flood protection to Upper Lake and surrounding areas.

In February 2016, a Consultant Selection Board selected Peterson Brustad Inc. to gather information and assist the County with the grant application and to prepare the Feasibility Study, if the grant were awarded.  The grant application was made and a grant in the amount of $499,971.00 was awarded in July, 2018. 

The Feasibility Study will develop and evaluate alternatives for a multi-benefit improvement project that:

1.                     Provides protection to the town of Upper Lake from 1% annual event (100-year flood) in accordance with state standards and FEMA NFIP standards.

2.                     Reduces sedimentation issues in Clover Creek, Alley Creek, Poge Creek, and Middle Creek above Scotts Creek Confluence and improves flood conveyance to reduce the risk of flood to the community of Upper Lake.

3.                     Addresses drainage issues along Middle Creek.

4.                     Enhances habitat, improves fish migration, creates recreational opportunities and protects state infrastructure (Highway 20).

 

The Program requires the grant applicant to be a local public agency with land use authority within the area protected by the SPFC facilities.  Therefore, the application is being made on behalf of the County of Lake and not the Lake County Watershed Protection District, which is responsible for maintaining the Project.

FISCAL IMPACT (Narrative):  Budget Unit 8108 includes $455,000 for the Feasibility Study.  The remaining $28,804 will be funded through a one-time contribution from 8109 and adjusted during midyear budget review.  The entire $483,804 will be reimbursed through the Program grant.
