EXECUTIVE SUMMARY:

 

The Community Development Department is responsible for inspection and enforcement of both the Lake County Storm Water Management Ordinance and the Lake County Grading Ordinance and over the last several years, a backlog of inspections built up due to staff shortages. In June of 2018 the Department was able to hire retired Resource Planner, Ron Yoder, to fill the position as an extra-help employee. Ron had previously worked for the Department from 2003 to 2011 as a Code Enforcement Officer and Resource Planner and during that time, provided inspection and compliance monitoring for the Department’s grading and stormwater enforcement responsibilities. During this time he became certified for both Erosion, Sediment and Stormwater Inspection and Stormwater Pollution Prevention (SWPPP). During his retirement, both certifications expired. 

 

While his application for extra help was being processed, the Department asked Ron if he could re-instate his certifications and he did so at his own cost ($551). The cost breakdown for the certification renewals are as follows: Envirocert $436- CPESC (Certified Profession in Erosion & Sediment Control) $135 for Renewal, $$125 for Reinstatement, $35 for Late Fee, $6 for Service Fee, CESSWI (Certified Erosion, Sediment, Stormwater Inspector) $100 Renewal Fee and $35 Late Fee; California Office of Water Programs (CASQUA) QSD (Qualifed SWPPP Developer) Late Renewal $115. These were the certifications that Ron held when he retired from the County. At the time of renewal (August 2018), he was told that he would be reimbursed due to requirements under California State Law, Health and Safety Code 18949.31. Certification is a requirement for the Grading and Storm Water Inspector II position.

 

When the check request was sent to the Auditor-Controllers office the request for payment was declined because they were unable to locate any policy providing for reimbursement to temporary employees. Given the unique nature and requirement of this temporary position as well as the requirements of California Health and Safety Code 18949.31, it is requested that the Board of Supervisors authorize payment.

 

Ron’s position is that of Grading and Stormwater Inspector and California State Health and Safety Code Sections 18949.25 - 18949.31 states in part, “that the local agency shall bear all costs of certification and education, renewal and continuing education as mandated by this chapter.” Section 18949.25 further states, “For purposes of this chapter, “construction inspector” means any person who is hired or contracted by a local agency in a temporary or permanent capacity of inspecting construction…”

 

The Grading and Storm Water Inspector II position requires plan check of grading and SWPP plans as well as field inspection. This position is clearly part of the Building Division and covered under the 2602 (Building) budget and is subject to this state requirement.
