SUBJECT:                     Consideration of allowing Cannabis Use Permit for Outdoor Cultivation Licenses to follow Fire Code 4290 as “agricultural” activity

EXECUTIVE SUMMARY:

 

Due to cannabis being an agricultural product and not an agricultural crop, it categorized under “commercial” activities.  Fire Code 4290 deems commercial activities as necessitating a much more stringent and dedicated road access construction needs.  This improved road access adds an unnecessary hurdle for a new and growing cannabis industry in our county.  Since the action allowed by our outdoor cannabis use permits mimic the same action that hemp, vineyards, or other agricultural activities, it is in the best interest to repeal this barrier by allowing outdoor cannabis cultivation permits to follow the Fire Code 4290 agricultural pathway.  This is only for outdoor cultivation use permits.
