SUBJECT: Consideration of Resolution Adopting recommendations to address Fire Safe Regulations applicable to Outdoor Cannabis Cultivation Operations
EXECUTIVE SUMMARY:
There is a need to clarify as to what type of activity is the cultivation of cannabis. Up till now, due to it being called “commercial cannabis” it has been deemed to be a commercial activity to cultivate cannabis. Due to this categorization, the current Public Resource Code 4290 & 4291 for State Responsibility Areas requires that a commercial road standard be met prior to operation.
After conversing with the California Department of Food and Agriculture, the agency that provides cultivation licenses to cannabis growers, it has been identified that the cultivation of cannabis is an agricultural activity, not a commercial activity. In order to rectify the issue, this resolution has been drafted for the board to review so that PRC 4290 & 4291 code can be followed via the “agricultural” exemption clause which does not require licensees to bring their roads up to a commercial standard.
There is currently no standard for agricultural roads.

Recommended Action
RECOMMENDED ACTION: Approve the resolution and seek consensus from the Board that its intentions are to move forward with seeking to create a uniform standard for agricultural roads.
