SUBJECT:                     (Sitting as the Lake County Watershed Protection District Board of Directors) (a) Waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of the goods or services and; (b) Approve the Agreement between the County of Lake and Paragon Partners, Ltd. In the amount of $103,400.00, for Property Acquisition Services for the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project and authorize the Chair of the Board of Directors to sign the Agreement

 

EXECUTIVE SUMMARY:

The Lake County Watershed Protection District (District) recently entered into a funding agreement with the State of California for fifteen (15) million dollars to be used for property acquisition as part of the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project (Project).  These funds will be used to purchase property from willing sellers that will be affected by the Project.  For the few remaining residential properties, which are a top priority with this round of funding, relocation assistance will be provided as part of these purchases.  The District has already spent nearly $10.2 million dollars on property acquisition using the services of Paragon Partners, Ltd. and staff proposes that they be retained to complete the additional purchases.

Paragon Partners, Ltd. (Paragon) was originally hired in October, 2012 following the County’s Consultant Selection Process wherein three consultants submitted proposals. Paragon was selected as the most qualified firm.  Five (5) Amendments to their original contract were made between 2012 and 2016, with Amendments 1, 3, and 5 adding additional scope and funding to their contract.  The other Amendments were for time extensions.  Paragon’s past record of performance on this project has been exemplary, as evidenced by the multiple amendments to increase the scope of services.

The State has given us a deadline of 2.5 years to expend these funds, which is an extremely short time frame, so time is of the essence to get the consultant started on the appraisal and purchasing process.  Staff recommends that your Board find that due to the unique nature of the services and Paragon’s thorough understanding of the processes required to complete the purchases, and that completing the Consultant Selection Process again will only delay the project and therefore is not in the public interest, that you waive the formal bidding process and approve the Agreement with Paragon Partners, Ltd. in an amount not to exceed $103,400.00.

Recommendation
