SUBJECT: Approve the Public Defender Contract Amendment Number 3 between the County of Lake and Lake Indigent Defense, LLP for Public Defender Services to extend the term of Agreement 14 months from November 1, 2019 through December 31, 2020 and increase monthly payment amount to $118,000 for a total of $3,962,000 and authorize the Chair to sign.
EXECUTIVE SUMMARY:
Staff continues to be involved in the process of rewriting and negotiating a new Agreement for Public Defender Services. In addition to the previously adopted Amendment Number 2 which extended the Agreement 4 months, staff requests an additional 14 month extension of the Agreement between the County of Lake and Lake Indigent Defense, LLP to complete this task.
The monthly payment increase is in response to the contractor experiencing increased workloads involving both criminal cases and conservatorship cases and the difficulty attracting and retaining qualified public defenders. This is the first payment increase in the Agreement amount since the Agreement began on February 1, 2018.
Amendment Number 3 revises Section 8: Compensation, Subsection D: Payments related to the payment amount of equal monthly payments from $110,000 to $118,000. Amendment Number 3 revises the total payments over the full term of the agreement from $2,310,000 to $3,962,000 and the term is revised from 21 months to a term of 35 months.
Amendment Number 3 revises Section 9: Term; Continuation of Representation related to the term of this Agreement from February 1, 2018 through and including October 31, 2019 to February 1, 2018 through and including December 31, 2020.

FISCAL IMPACT (Narrative): The adopted FY19/20 budget amount for the Lake Indigent Defense Public Defender Services Agreement equals $1,320,000. The proposed Amendment Number 3 results in a $64,000 increase in indigent defense service costs in FY19/20. Amendment Number 3 will be funded with a Budget Transfer from 23-80 Professional and Specialized Services to 23-98 Attorney Contract.
