SUBJECT:                     Consideration of an Ordinance amending specified sections of Chapter 13 of the Lake County Code relating to Administrative Fines for Violations of County Code relating to the failure to obtain Cannabis Cultivation Permits.

EXECUTIVE SUMMARY:

 

Attached for your Board’s initial review and consideration is a rough draft of an ordinance further amending Chapter 13 of the Lake County relating to the imposition of administrative fines relating to the failure to obtain cannabis cultivation permits. 

 

As the ordinance draft indicates, there is significant environmental damage which may result from unlicensed and unpermitted operations may constitute unfair business practice, putting those engaged in permitted cannabis cultivation operations at a distinct and significant disadvantage.

 

The ordinance as amended reflects the existing penalties which appear in Section 52.2 (b) (1) (2), and (3), but also reflects a per plant violation that would be incurred immediately and continue until the violations of this ordinance have been corrected. Finally, the ordinance draft refers to the ability of the County to bring an unfair business practices action as well as criminal prosecution.

 

This is a rough draft intended to spur discussion and consideration by your Board and comments from the public before proceeding with the ordinance in its final form.
