SUBJECT: Approve Amendment One between the County of Lake and Lake County Community Radio, Inc. for the Facility Space License Agreement located at 9289 Konocti Road, Kelseyville, CA (Buckingham Peak) in the reduced amount of $500 per month and authorize the Chair to sign.
EXECUTIVE SUMMARY: Lake County Community Radio (LCCR) leases tower space from the County of Lake on Buckingham Peak to accommodate their communications equipment. The license agreement was executed in 2007 with Buckingham Peak, LLC (which the County became the successor to upon purchase of Buckingham Peak), and includes a provision that the license fee shall be adjusted upward each year by the either 4% or the Consumer Price Index established in the agreement, whichever was greater.
Earlier this year the Board of Supervisors considered a request from LCCR to eliminate, or at least reduce, their monthly fee. Consequently the Board of Supervisors directed staff to revert the monthly fee to the original amount that was established in 2007, which was $500/month. To that end, staff has prepared the attached Amendment One to the Agreement setting the monthly rate at $500/month with language that the license fee is to be evaluated every fifth year to ensure the fee is still adequate to cover County of Lake costs of managing the tower space. Utility fees will remain the same based on usage.
